ソフトウェア(コンピュータプログラム)によって実現される機能的特徴を含む発明は、発明が解決する課題の解決策の詳細に関わる技術的考察が、その同じ発明を実施するために必要とされる場合には、EPC第52条(2)(c)及び(3)のもとで特許性を阻害されない。

 

 このような技術的考察は、解決すべき技術的課題を(暗示的に)技術的特徴によって暗示するという点で、発明に技術的性質を与える。

 

 この種の発明はEPC第52条(3)に基づくコンピュータプログラムそのものに属するものではない。

1.EPCは技術的特徴と非技術的特徴とが混在する発明の特許を妨げない。

2.クレームがコンピュータプログラムそのものに関するか否かを判断するために、技術的特徴と非技術的特徴とに相対的重みを付ける必要はない。クレームで規定された発明が技術的手段を用いているならば、これはEPC第52条から第57条までの要件を満足することを条件に、特許可能である。

発明の基礎をなしている概念が数学的方法であったとしても、発明がその方法を使用すた技術的プロセスに関するものであれば、数学的方法そのものではなく、特許の保護対象とすべきである。
